Buyer’s right to cancel: If within five business days you decide you do not wish to remain a member, you may cancel this agreement by mailing a notice to Big Guns Athletic Club by midnight of the fifth business day following your purchase of the contract. The written notice should state your desire to cancel and be mailed to 1480 NW 25th Ave., Chiefland, FL 32626.
Agreement
By signing, you enter into a membership agreement with the participating facility. All terms take effect on the date of signing. Terms and conditions may be updated at the discretion of Big Guns Athletic Club, and members will be notified of changes.
Membership cancellation
To cancel a membership, the member must visit Big Guns Athletic Club in person and complete a 30-day notice of cancellation, or mail a certified cancellation notice to 1480 NW 25th Ave., Chiefland, FL 32626. Phone calls and social media requests are not valid forms of cancellation. Members remain responsible for invoices falling within the 30-day notice period. An email confirmation will be sent when a mailed notice is received. Memberships remain active regardless of attendance until properly canceled.
Payment of fees
Membership fees are billed monthly. The membership agreement authorizes Big Guns Athletic Club LLC to charge the payment method on file. At least one month’s payment may be retained to cover unpaid balances or fees. Entry may be denied when payment is not received by the due date. Past-due amounts may continue to be collected through automatic debit and may be sent to collections. Members are responsible for applicable collection costs and legal fees.
Failed and late payments
Declined or returned payments may incur a $9.50 failed-payment fee. Payments more than 10 days late may incur a $15 late fee. Big Guns Athletic Club LLC and its authorized billing provider, currently Stripe, may draft amounts owed—including dues, service fees, and penalties—from the payment method on file, subject to applicable law.
Annual fees and dues changes
Big Guns Athletic Club may introduce an annual fee or change membership dues. The amount and date of fees are specified in the terms of each membership package. Changes will be posted at the front desk at least 30 days before taking effect and will be charged automatically to bank- or card-draft memberships.
Age and family restrictions
Family memberships are limited to immediate family members. Anyone 17 or younger must have written parent or guardian consent. Members age 15 or younger must be accompanied by an adult while in the facility.
Refunds
Membership payments and fees are non-refundable.
Membership changes
Memberships may be upgraded at any time, with adjusted dues or fees taking effect immediately. Memberships may not be downgraded during the current billing cycle. To move to a lower-tier membership, the member must cancel the current membership and re-enroll at the rates, terms, and fees then in effect.
Transaction fees
Membership prices are discounted for ACH withdrawal. Paying by credit or debit card, or changing the primary payment method to a credit or debit card, results in a $3 monthly increase.
Guest access and door security
Club access is limited to members covered by the current agreement and authorized guests. Each member must check in at the door or front desk during staffed and unstaffed hours. Allowing unauthorized entry, tailgating, or failing to check in a guest may result in membership cancellation, notification of law enforcement, and a fee of $50 to $150 per occurrence for each unauthorized individual. Big Guns Athletic Club is a private, members-only club with 24-hour video surveillance.
Media release
You consent to the facility’s use of photographs or video recordings taken of you or your minor children at the facility, including results or testimonials, for promotional purposes. To opt out, notify the facility in writing. The facility will make reasonable efforts to discontinue future use within 30 days of receiving notice.
